"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling charges, he was held in federal custody.

In her order, the judge pointed out that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
